Terms And Conditions
All advertising is accepted subject to the following:
1. Advertisements are accepted upon the representation
that the Advertiser and its agency have the right to publish the
contents thereof. In consideration of such publication, the Advertiser
and its agency agree to indemnify and hold Publisher harmless against
any expense or loss by reason of any claims arising out of publication.
2. Conditions, other than rates, are subject to change by the Publisher
without notice.
3. All contents of advertisements are subject to Publisher's approval.
Publisher reserves the right to reject, or cancel any advertisement,
insertion order, space reservation, or position commitment at any
time. Publisher reserves the right to insert the word "Advertisement"
above ads. 3.a. Refunds – Any Advertiser may cancel any advertisement
or insertion and request a full refund for any reason up to the
Ad Submission Deadline. After the Ad Submission Deadline Advertisers
are only eligible for product credit, at the discretion of the Publisher.
Cancellations must be submitted in writing. 3.b. Proofs –
The Publisher will attempt to get signed approved of all advertisements
by authorized representatives of the Advertiser. In order to remain
timely the Publisher may choose to run unapproved advertisements.
3.c. Tear-sheets – Upon publication each Advertiser will receive
a summary of the mailing, a copy of their advertisement for their
records, and a summary of their current account balance and activity.
3.d. Credit - Product credit will only be issued for errors, omissions,
or changes that were 1) requested in writing by the Advertiser and
2) affect a perspective customers ability to take advantage of the
advertisement. Mistakes eligible for product credit are limited
to incorrect contact information, pricing, or date-specific information.
All product credit is subject to approval at the sole discretion
of the Publishers.
4. Positioning and placement of advertisements is at the discretion
of the Publisher except where a request for a specific preferred
position is paid for by the Advertiser and is acknowledged by the
Publisher on the Letter of Intent to Advertise.
5. The Advertiser or its agency may not make cancellations or changes
in advertising or insertion orders after the Ad Submission Deadline
Date. If space is cancelled after the deadline or materials are
received too late, the Advertiser will be charged for the advertisement
or insertion.
6. A limited number of 1-Year Contracts are available for each Advertisement
Size. Contract holders may choose to cancel Contracts at any time.
Cancellation of Contracts for any reason will result in an adjustment
of the rate (short-rate) of advertisements printed during the term
of the Contract based on past and subsequent advertisements or insertions
to reflect actual space used at the earned frequency or volume rate,
by magazine.
7. Rates are subject to change upon notice from the Publisher. Should
a change in rates be made, space reserved may be cancelled by the
Advertiser or its agency at the time the change becomes effective
without incurring short-rate charges, provided the advertisement(s)
published to the date of cancellation are consistent with the appropriate
frequency or volume rate. Cancellation of space reservations for
any other reason in whole or part by the Advertiser will result
in an adjustment of the rate (short-rate) based on past and subsequent
insertions to reflect actual space used at the earned frequency
or volume rate.
8. Publisher shall not be liable for any costs or damages if for
any reason it fails to publish an advertisement. Publisher is not
liable for delays in delivery and/or non-delivery. 9. No conditions
other than those set forth in the Terms of Use shall be binding
on the Publisher unless specifically agreed to, in writing, by the
Publisher. Publisher will not be bound by conditions printed or
appearing in the contract, insertion order, purchase order, or any
other written documentation from the advertising agency or Advertiser
that conflict with the provisions of the Terms of Use. 10. The Terms
of Use constitute the entire agreement between you and Publisher,
and supercede any prior agreements between you and Publisher. You
also may be subject to additional terms and conditions that may
apply when you use affiliated services, nptraveler.com, iwilladvance.com,
northplattepowwow.com, third-party content or third-party software.
This Terms of Use and the relationship between you and Publisher
will be governed by the laws of the State of Nebraska without regard
to its conflict of law provisions. You and Publisher agree to submit
to the personal and exclusive jurisdiction of the courts located
within the County of Lincoln, State of Nebraska. The failure of
Publisher to exercise or enforce any right or provision of this
Terms of Use shall not constitute a waiver of such right or provision.
If any provision of this Terms of Use is found by a court of competent
jurisdiction to be invalid, the parties nevertheless agree that
the court should endeavor to give effect to the parties' intentions
as reflected in the provision, and the other provisions of this
Terms of Use remain in full force and effect. You agree that regardless
of any statute or law to the contrary, any claim or cause of action
arising out of or related to use of this Site or this Terms of Use
must be filed within one (1) year after such claim or cause of action
arose or be forever barred.. Top
